Quantum Sails respects your privacy. This Privacy Statement explains how Quantum Sails collects, uses and safeguards information on www.quantumsails.com. This Privacy Policy applies to information collected by Quantum Sails through its corporate website.

Quantum Sails reserves the right to amend this Privacy Policy at any time, for any reason. The date of the last revision to the Privacy Policy will be indicated by the "Last updated" date at the bottom of this page.

Information We Collect – When you browse quantumsails.com and do not interact with any online service or product from Quantum Sails, we do not collect personally identifiable information, such as your name, address, phone number and e-mail address.

When you become a registered user on our site or provide personally identifying information on our site in order to subscribe to Quantum Sails publications, download technical information, request a quote, purchase a Quantum Sails product, participate in online survey, submit questions or comments or request information or materials, we will retain certain personal information from you. The type of personal information collected will vary but may include name, address, phone number, billing and delivery information, sailing interests and type of boat, e-mail address, credit card or other financial account information and other demographic information. The type of information you provide will determine the personal information that is collected.

Making Sure Information is Accurate - Keeping your account information accurate and up to date is very important. If you believe your account information may be incomplete, inaccurate or not current, please use the Contact Us option on our site or contact your local sales representative.

Tracking & Cookies – We use your IP address, cookies and tags to track user behavior on our Sites and to make usability improvements. We also use cookies to maintain user session identity, site preferences, shopping carts, entry and exit page logging, and enable marketing research such as A/B testing and marketing campaign tracking. "Cookies" are small pieces of information that are stored by your browser on your computer's hard drive. This data allows us to build user profiles by starting from an email address, a personal name, or other information that the User provides to this Website, as well as to track User activities through analytics features. This Personal Data may be used to build private profiles that Quantum Sails can use for improving this website. In addition to services from other Advertising Service Providers, we use the following Google Analytics Advertising Features as part of our marketing analytics and advertising: Remarketing with Google Analytics, Google Display Network Impression Reporting, DoubleClick Platform integrations and Google Analytics Demographics and Interest Reporting. We may also use other services provided by Google Analytics from time to time. At present, Google provides users an opportunity to opt-out of the Google Analytics Features through Google's Ads Settings and their web browser opt-out plugin. However, we do not control these opt outs, which may be updated or removed by Google in accordance with its own policies. We may display interest-based ads to you when you are using Facebook or Instagram through a tool offered by Facebook called the Custom Audience Tool. This tool allows us to personalize our ads based on your shopping experience with us. We do not share your personal information, including your shopping history, with Facebook. This tool converts your email address to a unique number that Facebook uses to match to unique numbers Facebook generates from email addresses of its users.

With your consent our website uses the Conversion Tracking Pixel Service of Facebook, Inc., 1601 S. California Ave., Palo Alto, CA 94304, USA (“Facebook”). This allows us to follow user actions after they are forwarded to our website by clicking on a Facebook or Instagram ad. This enables us to record the effectiveness of Facebook advertising for statistical and market research purposes.

The collected data remain anonymous, which means we cannot see the personal data of individual users. However, the collected data are stored and processed by Facebook. Storage of conversion cookies is based on Art. 6(1)f GDPR. We analyze user behavior in order to optimize our web services and advertising.

Facebook can combine the data with the data for your Facebook account and uses the data for its own advertising purposes in accordance with the Facebook data guidelines https://www.facebook.com/about/privacy/ and Instagram's data policy: https://help.instagram.com/519522125107875?helpref=page_content.

Facebook Conversion Tracking also enables Facebook and its partners to show you advertising on and outside Facebook. In addition, a cookie is stored on your computer for these purposes.

Quantum Sails complies with the EU-U.S. DPF (Data Privacy Framework) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. Quantum Sails has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the EU-U.S. DPF Principles shall govern. In compliance with the EU-U.S. DPF Principles, Quantum Sails commits to resolve complaints about our collection or use of your personal information. EU individuals with inquiries or complaints regarding our EU-U.S. DPF policy should first contact Quantum Sails at communications@quantumsails.com, or you may send us a message via our Contact Us form.

In the future if Quantum Sails shares data, individuals may have the right to limit the use and disclosure of their personal information as required by the EU-U.S. DPF Principles, such as whether your personal information is disclosed to a third party or used for purposes materially different from the purpose for which the personal information was originally collected or subsequently authorized by you. Quantum Sails has further committed to cooperate with the panel established by the EU data protection authorities (DPAs) with regard to unresolved EU-U.S. DPF complaints concerning data transferred from the EU.

Quantum Sails is subject to investigatory and enforcement powers of the U.S. Federal Trade Commission.

Under certain conditions, you may invoke binding arbitration for complaints regarding our EU-U.S. DPF compliance. The criteria for this option are described here.

Pursuant to the EU-U.S. DPF Principles, Quantum Sail remains accountable for Personal Data that it receives under the EU-U.S. DPF and subsequently transfers to a third party agent. In particular, Quantum Sails remains responsible and liable under the EU-U.S. DPF Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the EU-U.S. DPF Principles, unless Quantum Sails proves that it is not responsible for the event giving rise to the damage.

E-mail Policy - Your e-mail address will only be used by Quantum Sails, its affiliated lofts, including service contractors, and approved marketing partners. We do not sell or rent e-mail addresses to any other parties outside Quantum Sails. For some e-mail messages distributed by Quantum Sails and its entities, specific information on recipient response is collected. For example, we sometimes review how many recipients open and subsequently choose to click through to links provided in an e-mail message. We use this information only for the purposes of analyzing areas of interest, improving our products and enhancing the usefulness of our Sites for Quantum Sails customers and other visitors. None of this information is sold or distributed outside of Quantum Sails in any manner.

We use MailChimp as out marketing automation platform. Email messages regarding product updates, events, news and the Quantum Sails newsletters are delivered via Mailchimp's email distribution service. Subscriber data is stored on MailChimp's servers according to their terms of use and privacy policy. Each email contains an Unsubscribe link at the bottom of the message; you may unsubscribe from a mailing list at any time by clicking the unsubscribe link, or you may contact your local sales representative to request removal from the Quantum Sails e-mail list.

Transactional emails are not subscription based and are not processed by MailChimp. These include order confirmations, form submission confirmations, and responses to user inquiries such as a service request.

With Whom We May Share Information – Quantum Sails may share personal information with our sales representatives in order to provide them an opportunity to offer products or services that may be of interest to you. Quantum Sails may occasionally share information with other companies hired to provide limited services on our behalf including, but not limited to, manufacturing, packaging, shipping and delivering purchased sails and related products, fulfillment of promotional offers and providing specialized sail care services. We will only provide those companies the information they need to deliver the service.

Quantum Sails may disclose your personal information if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process served on Quantum Sails; (b) protect and defend the rights or property of Quantum Sails; or (c) protect the personal safety of Quantum Sails personnel or members of the public in urgent circumstances.

Children’s Privacy Policy

Quantum Sails recognizes that some visitors to its website are children who sail. Because Quantum Sails does not collect personal information online from children under 13, young visitors with an interest in obtaining information from Quantum Sails are asked to involve their parents in this process. Parents are asked to submit their own personal information (not the child’s) as required for fulfilling a request for more information, a quote, product purchase or email subscription.

From time to time, Quantum Sails will announce regatta results for young sailors or post information authored by children about their sailing experiences with Quantum Sails products. In these cases, Quantum Sails will provide limited identification information such as name and yacht club as provided and/or approved by the parents and regatta organizers.

Use of Materials

The right to download and store or output information and materials from our site is granted for the user's personal use only, and materials may not be reproduced in any edited form. Any other reproduction, transmission, performance, display or editing of these materials by any means mechanical or electronic without the express written permission of Quantum Sails is strictly prohibited. Information Security

Quantum Sails implements commercially reasonable security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. We restrict access to personal information to Quantum’s business partners who may need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

User ID and Password

Certain areas of the Site require the use of a user ID (email address) and password as an additional security measure that helps protect your information. Passwords are encrypted and are not stored in our system in their original, plain-text version. If you lose or forget your password, a new one will need to be generated. Use the "Forgotten password" link on the login page to generate a new password. Instructions will then be sent to the email address associated with your account.

You should be aware that browser software often "caches" a page as you look at it, meaning that some pages are saved in your computer's temporary memory. Therefore, you may find that clicking on your "Back" button shows you a saved version of a previously viewed page. Caching in no way affects the security of your confidential user ID or password.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Accordingly, and despite our efforts, Quantum Sails cannot guarantee or warrant the security of any information you transmit to us, or to or from our online products or services.
